The City’s Site Alteration Bylaw prohibits or regulates placing or dumping of fill, the removal of topsoil, and the alteration of the grade of land within the city of Kingston. The original vision of the bylaw was to prevent the alteration of the grade of land outside the standard planning process. Changes to Provincial and Federal legislation have necessitated updates to the bylaw, now leading to a full review in order to try and better meet the needs of the community.
The review of the bylaw has identified several key areas to be updated including:
Updates to exemptions,
Updates to prohibitions,
Updates to the Permit Process Alignment with provincial and federal legislation,
Inclusion of a pilot program for increased oversight to be applied in UR4 zoning.

We are collecting feedback and input from community groups, partner organizations, businesses, and residents to ensure that the Site Alteration Bylaw is meeting the needs of the community. Public Information Centers will be held with affected groups and the general community as the City further refines the bylaw with community input. In addition to the draft bylaw a companion guideline is being developed to ensure process transparency and provide residents with a quick reference guide to the bylaw and to outline City expectations.
