Site Alteration Bylaw

The City’s Site Alteration Bylaw prohibits or regulates placing or dumping of fill, the removal of topsoil, and the alteration of the grade of land within the city of Kingston. The original vision of the bylaw was to prevent the alteration of the grade of land outside the standard planning process. Changes to Provincial and Federal legislation have necessitated updates to the bylaw, now leading to a full review in order to try and better meet the needs of the community.

The review of the bylaw has identified several key areas to be updated including:

  • Updates to exemptions,
  • Updates to prohibitions,
  • Updates to the Permit Process Alignment with provincial and federal legislation,
  • Inclusion of a pilot program for increased oversight to be applied in UR4 zoning.
